The United States now has a federal AI governance framework on paper. Whether it can hold the line against a rising tide of state-level legislation is the defining regulatory question of 2026.

On March 20, the White House released its National Policy Framework for Artificial Intelligence, a sweeping set of legislative recommendations designed to establish what it calls a “coherent, nationally unified approach” to AI governance. The framework doesn’t create binding law on its own — but it is already reshaping how regulators, companies, and courts think about who controls AI rules in America.

The Preemption Gambit

The framework’s most consequential element is its explicit recommendation for federal preemption of state AI laws. The administration urges Congress to override state regulations that “impose undue burdens” on AI development and deployment, with the stated goal of creating a single national standard rather than fifty competing ones.

The concern driving this position is practical: as of Q1 2026, at least 30 states have introduced more than 200 AI-related bills. Indiana (HB 1271), Utah (SB 319), and Washington (SB 5395) have already enacted laws restricting how AI can be used by health insurers to evaluate and deny claims. California, New York, and Texas have active legislation covering everything from AI hiring tools to autonomous weapons.

For technology companies, this patchwork is a compliance nightmare. For civil liberties advocates, federal preemption of more protective state laws is an alarm. For the administration, it is a strategic bet: a permissive federal floor, they argue, keeps American AI competitive with China and the European Union.

DOJ’s New Enforcement Arm

The framework’s teeth come from a parallel move at the Department of Justice. In January 2026, the DOJ established its AI Litigation Task Force — a specialized unit with “sole responsibility” to challenge state AI laws on three grounds: that they unconstitutionally regulate interstate commerce, that they are preempted by existing federal rules, or that they are “otherwise unlawful” in the Attorney General’s judgment.

That last category is broad by design. Legal observers at Baker Botts and Eversheds Sutherland have noted that the DOJ task force gives the administration an active enforcement instrument that does not depend on Congress passing new legislation. If a state law triggers the task force’s attention, the DOJ can challenge it in federal court immediately.

“The task force is the mechanism by which the White House framework becomes operational even before Congress acts,” wrote regulatory counsel at Wilson Sonsini in an April analysis. “It signals that the administration intends to shape the AI regulatory map through litigation, not just lobbying.”

Counting the Costs

The framework’s advocates argue that regulatory fragmentation is a genuine competitive threat. The EU AI Act, which is in its final compliance stretch, imposes substantial obligations on high-risk AI systems but applies uniformly across all 27 member states. China’s AI governance regime, while more opaque, similarly operates at a national level. A United States that cannot agree on basic AI rules state by state, the argument goes, cedes coherence to rivals that can.

Critics counter that federal preemption, especially the DOJ enforcement mechanism, would strip states of their traditional role as regulatory laboratories. The health insurance AI laws in Indiana, Utah, and Washington — which prevent insurers from using AI as the sole basis for denying medical claims — passed because state legislators felt federal consumer protections weren’t moving fast enough. Preempting those laws before federal alternatives exist leaves a gap.

What Comes Next

The framework is now before Congress, and prospects for a unified federal AI law in 2026 remain uncertain. Midterm dynamics, competing industry lobbying, and genuine philosophical differences between the parties about government’s role in technology make rapid legislation difficult.

In the meantime, the DOJ task force is operational, the state legislatures are active, and the courts will likely be the arena where the boundaries are actually drawn. For technology companies navigating this environment, the safest assumption is that the legal landscape will remain unsettled through the end of the year — and that compliance strategies built around any single regulatory regime should be designed to flex.
